This is the point. We have admitted we have broken the rules and from the ruling it’s obvious we have wilfully broken them. Whatever the mitigation to think our penalty will be totally dropped is naive.
Add to that the unsettling effect on the team of uncertainty then the only answer is move on.

Accept and move on.
Nuno and the players need to know exactly where they stand.
They won't know that if we appeal.

I’d be genuinely interested to know which five posters voted appeal and whether that is strictly on the basis that the deduction cannot be any worse, or whether it takes the prospect of that into account?

I will be voting to accept and move on. That said what if Everton receive a points deduction as well but they appeal and come the end of the season we are above them and avoid relegation and they then get some points back and go above us and we are now relegated. Had we only put the appeal in and had gotten a point back and stayed out of the relegation zone we would all be losing our heads for accepting it and moving on.
It's a tricky call to make.

I have just voted appeal.
Just incase anything comes in in Evertons case that would help us. If as expected it doesn't then withdraw the appeal before the hearing.

I voted appeal. For 3 main reasons - - I really do think we need to set out our stall again for the mitigating factors. This is in advance of another argument and to hopefully improve our P&S numbers significantly going into next season. If we can get them to agree about promotion bonusses and the COVID losses then we don't have to sell much before 30th June. Plus, if we get them to agree with the Brennan thing, if we do have to sell by 30th June, then perhaps we could play the same game as with Brennan rather than be in such a weak position that everyone knows we have to sell. I think on that point, we'd actually get a lot of support from a lot of clubs and maybe even the league because as others have said on another thread, it's going to be a nightmare this summer in the transfer market. There are going to be too many sellers, not enough buyers....
- It's 4 points to play for....this shouldn't be sniffed at. At worst, it might stop us being relegated, at best, it might mean we go up a few places in the final table, with a few extra million as a result. Understand the opposite perspective, but given that they dismissed all our mitigating points, an increase has got to be unlikely.
- If we really are going to try and generate some kind of 'screw you', we've been wronged spirit on the pitch....wouldn't it be a bit weird to not reflect that off the field?
Just my ways of thinking....I do completely get the idea of knowing what we've got now and making sure we outscore the other teams around us, without any uncertainty.

I voted appeal - initially as i thought i needed to vote something to see how the poll was going and wasn't thinking when i clicked it.
I would hope we do appeal ( as long as there is no possibility of our deduction being increased - and there seems lots of confusion around this).
I also think something may come out of the Everton hearing that leaves a bitter taste in our mouths. If we don't appeal we will have missed the opportunity. By lodging the intention to appeal we can monitor the Everton case with interest.
I am suspicious as to why the hearings haven't taken place at the same time and with it involving Scouses....
If Everton don't get a deduction for example or if the premier league have suggested a starting position of less than 8 points how would we be feeling if we hadn't appealed.....
Here we go.....

Appeal
Whilst I’d love to embrace the romantic view we can use this to rally the team and win more points than Luton anyway, I don’t trust the team to play consistently enough to do that. Or the referees.
I’ve said it elsewhere- masters moving the goalposts really has f****d us over.
There is easily sufficient grounds to suggest the mitigation was not fully considered.
With 160m at stake the club would be negligent not to try.
However, one caveat is that I assume the points can’t go higher if we do appeal; but after expressing my views about old Dicky Masters, I wouldn’t discount any lengths he might go to in order to properly f**k us over.
He lied to government ministers, so who knows what he’s capable of.
Better legal minds at the club will make the assessment though.

Appeal. I don’t trust the premier league. I am not an expert but from what i have read there seems to have been plenty mitigation which has not been taken into account

To be clear, (1) all of the mitigation has been taken into account albeit whether that was sufficiently argued would be a fault of ours not the decision makers and (2) there is absolutely nothing to dictate that upon appeal that the points deduction cannot be increased.
