Their losses are, before adjustments, roughly a quarter of a billion more as they had a higher threshold and covid write-offs we didn’t have, not to mention more time to rectify it and a higher threshold to start with.
They just can’t stop bleating can they?!
And the press say we have a victim complex…
Probably doesn’t help that Forest pushed for Everton’s hearing and subsequent points deduction to be held last season which would have relegated them. In addition we started a compensation claim against Everton.
Our actions really don’t help our own case sometimes, to be honest Im surprised how sympathetic some of them are to our case.

Has anyone heard anything about the threat that we would lose more points if we appealed?

Point deductions are a poor way of dealing with this.
The only fair solution is simply a fine. However not a fixed fine. To make the fine fair, the fine should be say 20% of the declared revenue used in the PSR calculations.
That way it hurts the same for a small and a big club, as they lose 20% of their revenue in a fine. The fine payment would be discounted then from future PSR calculations.
50% of the fine would be split among the other clubs in the division as a special bonus payment.
That would level the playing field and be a fair system.
So if Forest declare 50m revenue and pay a 20% fine its 10m fine.
IF City declare 500m revenue and pay a 20% fine its 100m fine.
That is a fair system in my opinion.

You cannot lose more points on appeal is what is being said.
You cannot submit any new evidence, all you can do is argue the same evidence again and hope the mitigating factors submitted gain some acceptance. Basically we will appeal that our mitigating factors were wrongly dismissed.
The way the Club Statement read, it means we will appeal.
If we end the season out of the relegation zone we will no doubt drop the appeal.
if we end the season in the relegation zone we will appeal and no doubt take legal action as well, against the PL and maybe PGMOL as well. This could have a very nasty ending to it if we dont finish above the drop zone.
Everton hearing will be in the next 2 weeks. I expect them to get a minimum of 4 points, perhaps 6 as they keep being uncooperative.
The wording is there.........Forest got 2 points back for reporting early and no fibbing and being awkward.
If you were awkward you get the full amount deducted.

We'd have to lodge any appeal before the end of the season. Before mid-April I think.

I hope that’s correct JWJW as I was struggling to see how anyone could threaten a points deduction before any appeal had been heard. Sounds like the PL trying to exert influence again (if it were true).
In the general courts a sentence appeal follows the same principle that arguments are on a point of law rather than new evidence, so it follows that the point of law is whether the mitigation was correctly considered by the panel. Definitely grounds for appeal imho.
However I do wonder if the recent precedent regarding Leicester’s situation would be admissible as a point of law. Probably not but I expect EM will be looking at every single possible argument, especially as it’s already within the existing mitigation arguments in a broader context.

Apparantly an appeal could increase the deduction but it’s extremely unlikely it would though, more chance of getting 1/2 points back than an increase, some of the arguments the commission rejected are quite eye opening. A few of them should have been accepted.

Time to lick our wounds and look forward to complete the season. It was always going to be down to results ON the pitch that would determine our fate. STOP feeling sorry for ourselves and get this current bunch of players motivated to get us out of the mess they have got us into. Forget VAR, crap referees and the PL hierarchy and get the job done for the club and supporters.

Might be worth waiting to see how the next two winnable home games go. Two wins and we could be back to 5 clear of Luton.

Indeed. We will have to appeal before the end of the season. Makes little sense forming one at the end dependent on how our season goes.
