Its Obvious that the defence will be around the Johnson sale and promotion bonuses
EFL allowed bonuses to be discounted so I am not sure how the Prem are allowed to overrule them and include in calculations

I doubt the delayed Johnson sale will work as mitigation. we waited until deadline day to sell him with no guarantee Levy would make the deal or land an alternative target. Additionally Johnson could have gotten injured or banned ect ect.
Hopefully the fact we were only in breach 2 months and we weren't in the prem the other two years will support a lesser sentence.
The rules are obviously flawed but this is poor from Forest. No doubt season ticket prices will go up and the renewal deadline will be before the outcome.
We can get the points though f**k it

Directors have a fiduciary obligation to maximise profits.
This is a matter of UK Law.
If Nffc fall foul of this, then the FFP rules mean they are discouraging directors from discharging their legal bound duties.

If the argument was to maximise profits then we probably shouldn't have lost 105m +, not sure how that I'd maximising profits.
Can't see us winning this personally.
Look at it this way, we had a 30m advantage let's say according to the rules on clubs that followed the rules. We then had a choice to either sell Brennan for below market value as a punishment or fail the rules and risk the consequences. We chose the latter and now we have to accept the punishment.

Ah f@(k.
Was always a possibility. My view:
1) Need to use it a bit to galvanise us and get loads of points to offset the possible points losses.
2) No Scouse style whinging about corruption and the like. Let our KC and his team do their thing at the commission and then accept the outcomes. We may have done the smart business and accounting thing. But we broke the FA rules as they stand, no matter how crap the rules may be.
3) No more "but what about Man City" they deny any wrong doing and if any of those 115 charges stick, they should have the book thrown at them. But its nowt to do with us.
4) Get our house in order going forward. If we stay up then this year's accounts need to be significantly better managed and wages off the bill asap of players not required ie trimming the fat to get wages down a fair bit.
January is a notoriously bad window for value. We still need a competent keeper desperately, but the rest should be outgoings of players not in 1st team or any offer we can get for "bomb squad" players to be taken off our hands.
I don't see the situation coming out of gross incompetence, more a bit of over enthusiasm where consequences were thought to be secondary to survival and the wriggle room became a bit too tight.
I repeat, if we hadn't signed Felipe and Navas in January we would be having this conversation in the Championship with a massive wage bill and hugely reduced income.
I don't think it serves much purpose to play the blame game at this point anyway.

Whilst accountancy rules may allow for the legitimate recognition of the Brennan sale (or at least part of it) in the previous year’s accounts, we don’t know whether that argument even is, or will be, part of our defence.
Additionally, as others have said, speculation about any penalties is pointless as there are two major aspects we don’t yet know-
1. what the accounting issues are that have caused us to go over the threshold (bonuses, Brennan or other); and
2. by how much we have actually exceeded the threshold.
Without this it’s impossible to make any meaningful guesstimates.

Here’s a quick conspiracy theory to ponder.
What if we are admitting our ‘breach’ and not kicking up a fuss like the scousers because we have already been tipped the wink by the PL that any punishment would be minor?
What if it’s Everton they are really after and not us?
What if we are a mere smokescreen to prevent the victimisation card being played?
I just think it’s peculiar that any final appeal decisions will take place after the season has ended, potentially facilitating manipulation of the final relegation standings.

You may be correct about Johnson. About ruining careers, sadly I don’t believe the Marinakis regime gives a monkeys about that considering some of the players at the two clubs that have been bought, swapped around, not played but moved on for a small profit or simply discarded.
