No, it relates to 2021/2022 season where Everton breached and Burnley went down having got four points less than them. They was then deducted 10 points the season after which went down to 6 on appeal. Burnley's argument is if they were penalised in the season they breached, they may have stayed up.
Looking at our breach season 2022/2023, Everton were below us and breached again. Leicester could have gone above us on goal difference had our 4 points been taken off that season. But they breached also if memory serves me, but got away without a penalisation.
