Fair points. It just seems though from what is being reported that if Lyon win their appeal Palace are kicked out EL but if Lyon lose their appeal, Palace will stay in EL. So the latter infers they would get away in that scenario with braking the rules.
They won't have broken the rules though will they as Textor won't have control over two clubs in the competition? Unless you consider the rule to be that no owner shall have a controlling influence over two clubs 'at the point in which they qualified' to play in Europe, not 'who will actually be competing in the tournament'.
That's the question. At the time of UEFA's deadline of March 1st they *had* broken the rules.
Yep. I'm no lawyer, but I reckon a court would determine that the significant issue at hand is who will actually be playing in the tournament, not who was breaking the rules at some arbitrary point in time, months before a ball is kicked.
By delaying I also think that UEFA are trying to give Palace as much chance as possible to enable them to compete, rather then kicking them out now, which I think is the right thing to do. Yes, we're affected to a certain degree, but that's the right thing to do really.
Thing is you can only interpret so much as a lawyer, ultimately the rules (laws) are made if if a deadline is missed, its only mitigation to say we didnt expect to be playing etc. Ultimately the sanction is set by precedent, lowest ranked club loses out.
Similar to the Johnson thing, the spirit of the rules should dictate the club holding out for the higher price but the letter of the law so to speak was the deadline.
A kind of real-life example would be if you drove a vehicle whilst disqualified despite having no knowledge of having been disqualified cos you were not at court or didnt get letters etc. Obviously you'd say, well its not my fault but letter of the law means you have to plead guilty as you drove and you were disqualified.

SR the difference is we came under the PL rules while Palace under UEFA so you can not conflate the two issues!

Em could have offered him a delayed payment deal on Danillo. Buy now pay later, versus cash up front for the Brazilian players.
